This is the legal agreement for
downloading, installing, or using an app (the Software)
between you and its author (Michel Fortin)
This End-User License Agreement (EULA) governs your acquisition and use of the Software, whether it was obtained directly from Michel Fortin or indirectly through a third party, with the following exceptions:
If you do not agree with the terms and conditions of this EULA, do not install or use the Software, and do not purchase a License Code for the Software.
If you are entering into this EULA on behalf of a company or other legal entity, you warrant that you have the legal authority to bind such entity to these terms and conditions.
Michel Fortin hereby grants you a non-transferable, non-exclusive, limited, revocable license to use the Software on your devices in accordance with the terms of this EULA.
You are permitted to copy the Software to devices (for example a computer, mobile phone, or tablet) under your control.
You are not permitted to edit, alter, modify, adapt, translate or otherwise change the whole or any part of the Software, except to the extent permitted by applicable law.
The Software may come with a limited trial mode. You agree not to try to circumvent limitations of the trial mode, including time limits and restricted functions.
You can choose to remove the trial-mode limitations of the Software by purchasing a License Code, which must be emitted in your name by Michel Fortin.
Usage Limits — By using a License Code you agree to be bound by the Usage Limits attached to it. This can be a maximum number of copies of the Software that can simultaneously use the License Code, a maximum number of users, or other terms as determined when the License Code was emitted for you.
Revocation — Michel Fortin might revoke a License Code when it appears its Usage Limits have been breached, whether by you or by third parties who might have used it. This can cause the Software to enforce again its trial-mode limitations. Michel Fortin may provide a replacement License Code if it is determined there was no intent to breach the Usage Limits on your part.
The Software (and the copyright, and other intellectual property rights in the Software) are and shall remain the property of Michel Fortin. This EULA is not a transfer of such rights.
This EULA is effective from the date you first use the Software and shall continue until you destroy all copies of the Software and all License Codes in your possession.
It will also terminate immediately if you fail to comply with any term of this EULA. Upon such termination, the license granted by this EULA will immediately terminate and you agree to stop all use of the Software and destroy all copies of the Software and all License Codes in your possession.
No warranties — Michel Fortin expressly disclaims any warranty for the Software. The Software and any related documentation is provided “as is” without warranty of any kind, either express or implied, including, without limitation, the implied warranties or merchantability, fitness for a particular purpose, or noninfringement. The entire risk arising out of use or performance of the Software remains with you.
No liability — Within limits allowed by law, in no event shall Michel Fortin be liable for any damages whether they be direct, indirect, accidental, consequential, special, incidental or of another nature (including, without limitation, damages for loss of income, interruption, loss of information, or any other pecuniary loss) arising out of the use of or inability to use this product, even if Michel Fortin is aware of the possibility of such damages and known defects.
This EULA shall be governed by and construed in accordance with the laws of the province of Quebec in Canada. Any dispute arising out of or in connection with this EULA shall be submitted to the judicial district of Quebec.
